Photographs comparing No Harm, No Foul to the movie, Life


The photographs below were presented by Hudson as evidence that Eddie Murphy and the defendants copied from his plays No Harm, No Foul and Bronx House to make the motion picture Life.


The standard for proof of copying as a matter of law is "whether an average lay observer (an average or everyday person) would recognize the alleged copy as having been appropriated from the copyrighted work."


Judge Block ruled against Hudson citing,  "After reading the scripts and viewing the movie and the play, the Court concludes that no reasonable jury could find a substantial similarity between the protected elements of No Harm, No Foul and Life."As a reasonable person, what's your conclusion? Hudson argued in the Eastern District Court of New York and in the Second Circuit Court of Appeals that the characters in both of these works are so substantially similar that they can be inter-changed from film to play and vice-versa.  Both Courts ruled that "a reasonably Jury could not see substantial similarity between the two works."
